Contractual terms

By buying a coupon for 100, - Euros for a dinner for 2 persons in the restaurant Rodolfo (Pastahouse) in Moraira, Costa Blanca, Spain, the purchaser of the coupon also gets a free lottery / registration number for participation in the drawing of Pastahouse Italia.

The object of the lottery drawing

is 100% of the company shares of Mr. Rolf Emmenecker, who is the manager-owner of Pastahouse Italia GMBH (registered since 2001) and the operator of the Italian restaurant Rodolfo (Pastahouse) in the rented space in 03725 Moraira (Teulada) - Edif. Kristalmar 22D - Tax ID B 535 615 02 - Registro Mercantil de Alicante, Tomo 2436, Folio 96, Sección 8, Hoja A 64674, as well as the licence.

Only the assets of the company, which are free of financial obligations and leasing contracts, as well as the complete furniture and equipment will be acquired.

The rent of the office rooms has already been paid for a period of 13 months starting from the day of transfer of the company to the lucky winner at the public notary. The monthly rent currently amounts to 2,300, - Euros for an area of 210 m2.

A total of 2,999 coupons worth 100, - Euros each for a dinner for 2 persons with a free registration / lottery number are being sold.

II. Conditions of participation:
1. Persons entitled to participate are legal and natural persons; at the time of drawing, natural persons should be of full legal age (completed 18 years of age) and capacity.

2. Participation is only possible via the participatory user interface that is created by the owner, Rolf Emmenecker in the Internet; the participant's personal data, such as full name, birth date, country and email address and the number of desired tickets for a dinner with a free registration / lottery number must be specified while purchasing a coupon.

3. The participant is liable for the accuracy of personal data as well as the bank and credit card information.

4. A free registration / lottery number is assigned upon each purchase of a dinner coupon. This registration / lottery number is used to determine the winner of the lottery.

III. Payment via credit card
1. The lottery ticket(s) is/are valid after completion of payment and after receipt of the confirmation with the registration / lottery number.

2. The tickets with the registration / lottery number will be sent by e-mail immediately after the completion of payment.

IV Payment via wire transfer

1. Payments via wire transfer are only possible if "wire transfer" had been selected as the payment option upon registration. This registration reserves the desired number of coupons / free lottery tickets for a period of 14 days.

2. In case of a wire transfer, the name of the registered person / beneficiary and the email address have to be specified under the field "notes".

3. The same participant may repeatedly register for the purchase of a coupon via wire transfer. For example: 2 coupons = 200, - Euros, a registration number and a free lottery number per coupon.

5. After receipt of payment on the account and the completion of payment, you will receive the coupon(s) and the lottery ticket(s) with the lot number by email.

6. Cash receipts under 99, - € as well as surplus amounts from coupon purchase will be void and will not be refunded.

V. Number of coupons with free lot numbers, price

1. 2,999 vouchers and free lottery tickets with lot numbers will be issued, whereby a multiple purchase of coupons is possible. The price of a coupon is € 100, - (one hundred Euros), valid until 31.12.09

VI. Redemption of the coupons for dinner
Each holder of a coupon can redeem the same for a dinner for two at a value of € 100 until 31.12.09. The original email should also be presented along with the coupon. There will be no cash refund for consumption below the value of the coupon(s). The coupon is invalidated in the restaurant; however, the issued free registration / lottery number remains valid until the drawing.

VII Schedule of the lottery drawing
1) The drawing will take place on 15.01.10, under the supervision of a notary in Austria.
The decision is final.

VIII. Reversed transaction
If not all of the 2,999 vouchers are sold until 31.12.2009, the owner has the right to cancel the drawing. All coupon holders will be informed by email and could apply for the refund amount minus 20 Euros processing fee via wire transfer, provided the dinner has not been availed. Otherwise the coupons are valid until 30.06.2010.

IX. Notification of the winner

1. After completion of the drawing, the winner is selected from the list of lot numbers.

2. The winner is notified at his specified email address.

3. In addition, the winner or the respective lawful successor has to claim the prize within a period of 30 days from the date following the day of lottery drawing. If the notification process was unsuccessful and the winner does not claim the prize within the aforementioned 30-day period, a new drawing will take place within three business days.

X. Costs and Fees

1. All necessary costs of the lottery, taxes, fees of the transfer of shares and notary costs will be borne by the owner.

XI. Privacy Policy

1. All data of the participants are kept confidential in line with the international data protection provisions and deleted from the electronic system after fulfilment of property acquisition.
